1. Introduction

Welcome to The Violet Frame by De Lissandri Creative Studio (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website [www.thevioletframe.com] and the purchase of our products (digital recipes) and services (food photography).

By accessing our website or purchasing from us, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

2. PART A: Sale of Content for Creatives (Exclusives & Semi-Exclusives)

These terms apply specifically to the purchase of “Exclusive” and “Semi-Exclusive” recipe content packages from our shop.

2.1. Definitions of Product Types
  • “Exclusive Content”: A unique package containing a recipe and a full set of photographs. This package is sold to only one buyer.
  • “Semi-Exclusive Content”: A package containing a recipe and a specific set of photographs. While the hero photographs in your package are unique to you, you acknowledge that we may have created other sets of hero photographs for the same recipe and that ingredients/process shots are non-unique. These photographs may be sold to other parties or retained by us.
2.2. Transfer of Copyright (Intellectual Property)

Upon your payment in full and the successful download of the digital files, The Violet Frame assigns and transfers to you (the Client) the copyright ownership of the specific photographs and recipe text included in your purchased package.

This means:

  • You own the images and the text.
  • You may edit, brand, and publish the content on your website, social media, or e-books as your own.
  • You may claim authorship of the content.

Important Limitation for Semi-Exclusives: If you purchase a Semi-Exclusive package, you acknowledge that the recipe concept itself may not be unique to you, as other variations of the shoot (different angles/props) may exist and be sold elsewhere. However, the specific hero image files you purchased are yours.

2.3. Seller’s Retained Rights (Portfolio License)

Although copyright has been transferred to you, The Violet Frame retains a perpetual, non-exclusive, worldwide, royalty-free license to use a selection of the images (typically 4-5 images) for self-promotional and marketing purposes only.

  • We may display these images on our portfolio, website, Instagram, or other social media channels to showcase our work.
  • We will not resell these specific images to third parties (e.g., stock photography sites) as the copyright now belongs to you.
2.4. No Refunds on Intellectual Property

Because these products involve the permanent transfer of Intellectual Property and immediate access to high-resolution files, all sales are final.

  • We do not offer refunds, returns, or exchanges on Exclusive or Semi-Exclusive content.
  • By purchasing, you agree to waive any right of withdrawal once the download has commenced.
2.5. Prices and Payment

All prices are listed in the currency displayed on the website. We reserve the right to change prices at any time. Payments are processed securely via Payrexx.

3. PART B: Photography & Content Services

These terms apply when you hire The Violet Frame for custom photography, recipe recreations, testing, development, or writing services.

3.1. Service Types & Copyright Distinction

Because we offer different types of services, the ownership of the final work depends on the service booked:

A. Commercial & Brand Photography (Restaurants, Food Brands, large-scale publishers)
  • Unless otherwise specified in a separate proposal, The Violet Frame retains the copyright to all images.
  • You are granted a Usage License to use the images for your marketing (web, social, print) as defined in our quote/invoice.
  • Overrides: If we sign a specific Commercial Service Agreement, the terms of that agreement will take precedence over this website policy.
B. Recipe Recreations (For Food Bloggers)
  • This service involves us recreating and photographing a recipe provided by you.
  • Upon payment in full, we assign and transfer the copyright of the final high-resolution images to you.
  • Portfolio Rights: We retain the right to use 4-5 images from the shoot for our own self-promotion and portfolio.
  • Exclusivity: We guarantee that these specific images are unique to you and will not be resold to other clients.
C. Recipe Testing, Writing, and Development (for food bloggers)
  • Testing Photos: Photos provided during “Recipe Testing” are for documentation/reference purposes only (e.g., smartphone quality) to show the result. They are not intended for professional publication unless upgrades are purchased.
  • Writing Services: When we write or format blog posts/recipes for you, the final text is your property upon payment.
3.2. Client Responsibilities (The “Failed Recipe” Clause)

For Recipe Recreations and Testing, we strictly follow the recipe instructions you provide.

  • Outcome: If the recipe fails (e.g., the cake sinks, the sauce splits) due to errors in your provided recipe and not our technique, you are still liable for the full service fee.
  • Re-Shoots: Re-shoots required due to recipe errors or changes in the creative brief after the shoot has started will be invoiced separately at a discounted rate.
3.3. Booking and Cancellations
  • Confirmation: A booking is only confirmed once a deposit (if requested) is paid or a contract is signed.
  • Cancellation by Client: Cancellations made with less than 48 hours’ notice may be subject to a cancellation fee to cover the reserved studio time and perishable ingredients purchased.
  • Cancellation by Us: In the unlikely event of illness or emergency, we will offer a full refund or a priority reschedule date.
3.4. Delivery
  • Method: Final files are delivered via Google Drive.
  • Timeline: Standard delivery is within 10 business days of the shoot, unless a rush fee is paid.
  • Storage: We recommend you download and back up your files immediately. We are not responsible for archiving your files indefinitely after 12 months.

4. Food Safety & Liability Disclaimer

Please read this carefully. We work hard to ensure our recipes are accurate and tested. However:

  1. Outcome: We can only guarantee the outcome of a recipe if instructions are followed as provided. The Violet Frame is not liable for recipe failure caused by variables like ingredient substitutions, alternative cooking methods, and/or other adaptations.
  2. Health & Safety: You are responsible for ensuring that any food you cook is safe to eat. You are responsible for checking ingredients for allergies. The Violet Frame is not liable for any adverse reactions, foodborne illness, or domestic accidents resulting from the preparation of our recipes.

5. Intellectual Property (Website Content)

All content on this website—including the logo, visual design, text, recipe steps, and photographs—is the property of The Violet Frame and is protected by Swiss and international copyright laws. You may not copy our website design or steal our photos.

6. Third-Party Links

Our website may contain links to third-party websites (e.g., affiliate links to kitchen tools). We are not responsible for the content or practices of these external sites.

7. Limitation of Liability

To the fullest extent permitted by law, The Violet Frame shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the website or products. Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid to us in the last 6 months.

8. Governing Law and Jurisdiction

These Terms are governed by the laws of Switzerland. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Canton of Geneva, Switzerland.
